Man Sentenced to One Year Imprisonment, ₹12 Lakh Fine in Cheque Bounce Case

Bandipora: In a significant judgment, the Court of Judicial Magistrate 1st Class, Sumbal, convicted Ghulam Hassan Bhat of Kathpora Hajin Bandipora under Section 138 of the Negotiable Instruments Act for issuing a dishonored cheque. The court sentenced him to one year of simple imprisonment and imposed a fine of ₹12 lakh as compensation to the complainant, Bashir Ahmad Dar.

The case, filed in 2017, revolved around a financial dispute wherein the accused had issued a cheque that was dishonored due to insufficient funds. While the defense argued for leniency, citing that the offense was financial in nature and did not involve moral turpitude, the complainant’s counsel urged for stringent punishment, emphasizing the need to uphold financial discipline and deter similar offenses.

After hearing both sides, the court ruled that mere imposition of a fine would not serve justice, given the accused’s conduct. The convict has been ordered to serve his sentence in District Jail Pulwama and pay ₹12 lakh to the complainant as compensation.

The judgment reinforces the legal framework ensuring accountability in financial transactions and serves as a cautionary precedent for those who fail to honor their financial commitments.

Advocate Jalal Uddin, who represented the complainant in the case, while sharing details with the media, stated that the verdict is a major step toward ensuring financial discipline. He emphasized that this decision sends a strong message against financial fraud and protects the credibility of negotiable instruments. He further added that the complainant suffered financial distress due to the dishonor of the cheque, and this judgment upholds his right to justice.
