Srinagar: The Jammu and Kashmir High Court has taken strong exception to the non-compliance of its orders by the District Collector of Ganderbal, directing the contemnor to remain present in court on Monday.
The court’s directive comes after it was brought to its notice that the District Collector had failed to implement its orders in a case related to land acquisition and subsequently not compensating the landowners despite court directions.
The issue pertains to a case regarding land acquisition, in which the petitioners approached Qureshi’s court saying they were not compensated by the government after it acquired land from them, even though a decree in this regard was issued in 2022.
Fayaz Ahmad Qureshi, a sub-judge in the Ganderbal district court, had accused Deputy Commissioner Shymabir of launching an inquiry into land owned by him as “revenge” for an earlier order. The judge had asked the DC to explain why he should not be referred to the J&K High Court for criminal contempt proceedings.
Despite repeated reminders, the official chose to ignore the court’s directives, prompting the High Court to initiate contempt proceedings.
A Division Bench of Jammu Kashmir and Ladakh High Court comprising Judge Sanjeev Kumar and Judge Atul Sreedharan directed the DC Ganderbal to remain present in person on Monday, August 5, 2024 at 11 AM.
“Any attempt by him (DC Ganderbal) to avoid service of summons or his non-appearance shall be viewed seriously by the court and the court shall resort to coercive proceedings to secure his presence,” the court. [KNT]
