Anti-corruption court orders to frame charges against former IAS officer, others

SRINAGAR: In the much publicized fraudulent and manipulated auction of Anand Bricks and Jammu Ceramics, Special Judge Anti-Corruption Jammu Yash Paul Bourney has passed order for framing of charges against former IAS officer and several others under J&K Prevention of Corruption Act and various provisions of RPC.

In a landmark Judgment in the much publicized fraudulent and manipulated auction of M/S Anand Bricks Pvt. Ltd. and M/s Jammu Ceramics Pvt. Ltd. by an ex-IAS officer Ejaz Iqbal, the Special Judge Anti-Corruption Jammu on 02-05-2019 passed a significant order for framing of charges against ex-IAS Officer and the then MD J&K State Financial Corporation (JKSFC) Ejaz Iqbal along with Rajinder Prasad, then Chief Manager large branch office SFC, Ravinder Mishra, then Manager Industries large branch office SFC, Bhola Nath Sharma, then Assistant Manager large branch office SFC, Rakesh Kumar Choudhary (brother of Nagar Singh) S/o Koula Ram R/o H.No. 51 B/D Gandhi Nagar Jammu (Private person), Amit Kumar Gupta S/o Ashok Kumar Gupta R/o H.No. 21 Sec-6 Trikuta Nagar Jammu (Private person) and Ravi Gautam S/o Madan Lal R/o W.No. 59 Channi Himmat Jammu (Private person) under section 5(1)(c)(d) read with 5(2) J&K P.C. Act Svt. 2006 and section 467, 468, 471, 419, 420, 201 and 120-B RPC for abuse and misuse of official position in the forged and manipulated auction of M/S Anand Bricks Pvt. Ltd and M/S Jammu Ceramics Pvt. Ltd. located at Kangrail Mishriwala, Jammu belonging to Late Sh. Rabinder Nath Anand.

Aslam Din Choudhary then Naib-Tehsildar Bhalwal, accused no. 2 in the challan produced by Anti corruption Bureau reportedly died during the proceedings of hearing of charges. The court found no significant material on record against Sham Lal Gupta (Surveyor) R/o 61 B/B Gandhi Nagar Jammu (Private person) and Ram Dayal then Patwari Halqa Kangrail.

After the case was registered in P/S ACB on 19-05-2011, joint raids were conducted by the teams of ACB in the premises of large branch offices of SFC Jammu and Srinagar simultaneously on 20-05-2011 following the allegations of fraudulent and manipulated auction done in the year 2009 of M/S Anand Bricks Pvt. Ltd and M/S Jammu Ceramics Pvt. Ltd. belonging to Late Sh. Rabinder Nath Anand located at Kangrail Mishriwala, Jammu by Ejaz Iqbal and other accused.

According to the case filed by the Anti corruption Bureau, the accused ex-IAS officer Ejaz Iqbal along with other officials of SFC and Revenue Department in criminal conspiracy with each other and with Rakesh Choudhary & Amit Gupta with full knowledge and dishonest intentions forged the papers for the change of title of land owned by late Sh. Rabinder Nath Anand from ‘Lease Hold Rights’ to ‘Absolute Ownership Rights’ over approximately 59 Kanals 01 Marlas of land where upon superstructures of M/S Anand Bricks Pvt. Ltd and M/S Jammu Ceramics Pvt. Ltd. were raised, through a fraudulent and manipulated auction process thereby causing wrongful and huge loss to the extent of Rs. 108 lakhs approximately to J&K State Financial Corporation and loss of land and assets amounting into crores of rupees to the legal heirs of Late Sh. Rabinder Nath Anand and corresponding gain to aforesaid accused persons.

After investigation a formal case FIR No. 07/2011 was registered at Police Station ACB against ex-IAS Officer Ejaz Iqbal the then MD J&K State Financial Corporation along with Rajinder Prasad, then Chief Manager large branch office SFC, Ravinder Mishra, then Manager Industries large branch office SFC, Bhola Nath Sharma, then Assistant Manager large branch office SFC and other above mentioned public servants and Rakesh Choudhary and Amit Gupta.

The Anti corruption Bureau subsequently produced the challan in the case FIR No. 07/2011 under section 5(1)(c)(d) read with 5(2) J&K P.C.Act Svt.2006 and section 467, 468, 471, 419, 420, 201 and 120-B RPC in the court of Special Judge, Anti-corruption, Jammu on 23-03-2017.

Special Judge Anti-Corruption Jammu after conclusion of arguments ordered on 02-05-2019 that there is sufficient material to frame charges against the accused under section 5(1)(c)(d) read with 5(2) J&K P.C.Act Svt.2006 and section 467, 468, 471, 419, 420, 201 and 120-B RPC. (PTK)
