Delhi High court refuses to entertain plea seeking direction to ECI to bar Mehooba, Farooq, Omar from contesting elections

SRINAGAR: The Delhi High Court today refused to entertain a plea seeking a direction to the Election Commission to bar Mehbooba Mufti, Farooq Abdullah and Omar Abdullah from contesting elections on account of making seditious and communal statements.

The petition was withdrawn after Division Bench of Justices S Ravindra Bhat and Prateek Jalan asked the Petitioner to approach the Election Commission instead.

Filed through Petitioner in person, advocate Sanjjiivv Kkumar, the Petition had claimed that the Election Commission should impose conditions to ban their entries into the Lok Sabha as “their loyalties lie somewhere else and not in Indian Constitution”.

The Petitioner had referred to a series of statements made by the three political leaders to sustain his allegation.

“That, on Feb 24, 2019, MP and Ex-CM Madam Mehbooba Mufti tweeted the following Seditious and Threatening  Statement pertaining to Muslim Majority J&K:  Again on 4th April 2019, she gave Seditious statement that India would be occupational force and J&K will be like Palestine, if Article 370 if withdrawn by the Government of India.”

“Mehbooba Mufti also said, ‘Don’t fiddle with 35A. If you do so the consequences will be so grave that you’ll see such things which you would have not seen since 1947.“

“That, Shri Omar Abdullah Ex CM and Ex MP and his father Farooq Abdullah Ex Cm and MP, gave seditious statements that J&K should have separate Prime Minister. The National Conference (NC) chief also backed his son and party vice-president Omar Abdullah’s comments on Monday, April 3 that the NC would seek restoration of terms of accession of the state, including the provision for ‘Sadr-e-Riyasat’ and prime minister posts.”

The Petitioner had contended that the two mainstream parties in the Kashmir, Jammu & Kashmir National Congress and the Jammu and Kashmir Peoples Democratic Party, were “increasingly losing their identity” as they want “J&K state to segregate from India on the basis of Muslim Majority“. (PTK)
